Welcome to Madison Enterprises Global LLP, trading as Madison Cards (“we”, “us”, “our”).

By using our website www.madison.cards (“the Website”), you agree to be bound by these Terms of Use & Sale (“Terms”). These Terms govern your access to and use of the Website, including any purchases of physical products or digital downloads.

If you do not agree with any part of these Terms, please refrain from using the Website.

These Terms and any transactions conducted on this Website are governed by and construed in accordance with the laws of England & Wales.

2. Use of the Website

By accessing or using this Website, you warrant that:

- You are at least 18 years old, or you have permission from a legal guardian to use this Website.

- You will use the Website in compliance with all applicable laws and regulations.

3. Products and Availability

We sell both physical products (e.g., playing cards, apparel) and digital downloadables (e.g., tutorials, books, artwork).

We make every effort to ensure product descriptions, images, and prices are accurate, but minor variations may occur. Product availability is subject to change without notice.

4. Digital Downloadables

4.1. License for Digital Content

When you purchase digital content, you are granted a non-exclusive, non-transferable licence to use the content for your own personal, private use.

You may not copy, share, distribute, sell, or commercially exploit any digital downloads.
Any breach may result in legal action and the termination of your access to future purchases or services associated with Daniel Madison or Madison Cards.

4.2. No Refunds for Digital Products

All digital product sales are final. Once purchased and delivered, digital downloads cannot be refunded, exchanged, or cancelled.

By completing a digital purchase, you acknowledge and agree to waive your statutory right to a cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

5. Physical Products

5.1. Pricing and Payment

All prices are listed in GBP (£) and include VAT where applicable.

We accept payment through secure checkout services (Shopify, PayPal, and other approved processors).

We reserve the right to adjust prices without notice, but such changes will not affect orders already placed.

6. Delivery and Shipping

6.1. Current Shipping Method — FedEx DDP

All international orders are now shipped via FedEx DDP (Delivered Duty Paid).

This means:

- All import duties and taxes are included in the checkout price.

- No further payment is required for delivery.

- Typical delivery time: 3–7 working days, depending on destination.

6.2. Legacy MHI DDU Orders

Orders previously shipped or pre-sold under MHI DDU (Delivered Duty Unpaid) terms remain subject to those original shipping conditions.

For DDU orders:

- The customer is responsible for all import duties, taxes, and local courier fees.

- Failure to pay these charges may result in delay, non-delivery, or return.

- We do not issue refunds for DDU orders that are refused, unclaimed, unpaid, or destroyed by customs.

- If and when a parcel is returned to us in good condition, we may, at our discretion, offer reshipment once new shipping costs are paid in full.

6.3. Pre-Sale Orders

Pre-sale items are offered on a flexible dispatch basis. Estimated shipping dates (e.g. “late October to mid-November”) are for guidance only and may change.

Full payment is taken at checkout to reserve your order.

Pre-sale orders cannot be cancelled prior to dispatch unless otherwise specified.

6.4. UK & EU Orders

UK and EU orders are dispatched from our UK warehouse and typically arrive within 2–10 working days, depending on location.

Customs charges may apply to EU orders following Brexit; these are payable by the customer.

6.5. Delivery Times

All delivery times provided are estimates only. We are not liable for delays caused by customs clearance, postal services, or circumstances beyond our control.

6.6. Incorrect Address or Delivery Failure

Please ensure your shipping address is accurate.

We are not responsible for delays, losses, or returns due to incorrect or incomplete addresses. Reshipment costs must be covered by the customer.

7. Returns, Exchanges & Cancellations

7.1. Returns and Exchanges (Physical Goods)

We accept returns or exchanges only if items are:

- Damaged or faulty on arrival, or

- Incorrectly fulfilled.

To initiate a return, contact team@madison.cards within 7 days of receipt with proof of the issue.

We do not accept returns, exchanges, or refunds for:

- Change of mind or unwanted items

- Sale or discounted items

- Custom-made or personalised products

- DDU shipments refused or returned due to unpaid customs fees

Your statutory rights under UK law remain unaffected.

7.2. Bespoke, Personalised, and Made-to-Order Items

Bespoke, personalised, or made-to-order items cannot be cancelled, returned, or refunded once production has begun.

This policy does not affect your statutory rights for defective items.

8. Intellectual Property

All content on this Website — including text, graphics, logos, videos, photographs, and downloadable products — is the intellectual property of Daniel Madison and Madison Enterprises Global LLP, or their licensors.

You may not reproduce, distribute, modify, or use any material for commercial purposes without prior written consent.

9. Limitation of Liability

Daniel Madison and/or Madison Enterprises Global LLP are not liable for any indirect, incidental, or consequential loss or damage arising from your use of the Website or any products purchased through it.

Our total liability shall not exceed the total price of the order in question.

11. Changes to Terms

We may update or modify these Terms from time to time.

Changes will take effect immediately upon posting to the Website.

These Terms and any transactions or disputes arising under them shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
